Family law mediation is used to settle family disputes such as divorce, custody, parent-time, and paternity. With family mediation, an unbiased and experienced third-party mediator helps the parents reach an agreement on the difficult and complicated issues listed above. Family mediation is required by law in most divorce and custody cases. Family mediation can save parties’ the time and money associated with a trial. The conclusions or agreements reached in mediation become legally binding on the parties and are frequently filed with the courts.

What happens in Mediation?

Most mediations last between 4 and 8 hours, depending on the complexity of the case. The parties are usually situated in separate rooms with own attorneys. The mediator alternates between rooms to discuss aspects of the case, all while working to draft an agreement/stipulation which both parties are willing to sign. Your attorney will be present throughout the mediation to advise you about the best courses of action. Your attorney will also discuss the legal merits of your case and advocate your cause to the mediator and opposing counsel.
